Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the vDOC.AI website and platform (the"Service") operated by vDOC.AI LLC ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Description of Service
vDOC.AI is a medical training simulation platform intended solely for educational purposes. It provides simulated medical scenarios for training and evaluation but is not intended for use in actual medical diagnosis or treatment.
3. Eligibility
You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age. The Service is not intended for use by minors under any circumstances.
4. License Key Usage
After completing the purchase process, a unique license key will be issued to the purchaser. This license key must be entered into the vDOC launcher to activate the full version of the software. Each license key: Is issued once per purchase, is valid for activation on one machine, may not be reused across multiple devices, may not be shared with other user. The license key is considered consumed once it has been activated.
4.1 Non-Transferable License
All vDOC licenses are non-transferable. The purchaser may not: Sell, transfer, sublicense, or redistribute the license key, share the license key with other users, or use the license key on multiple computers, licenses are intended for the original purchaser only.
4.2 Device Activation
During activation, the license key may be associated with a specific machine identifier in order to enforce the single-device license policy. Attempts to activate the same license key on multiple devices may result in: Activation failure, license suspension or revocation of the license key.
4.3 Refund Policy
Due to the nature of software licensing and the immediate delivery of license keys upon purchase, all purchases are considered final once the license key has been issued. Refunds may only be considered in cases of: Duplicate purchases or technical issues that prevent activation and cannot be resolved by support. Requests for assistance should be directed to the vDOC support team.
4.4 Updates to Licensing Terms
vDOC may update licensing policies or terms from time to time. Continued use of the software constitutes acceptance of the most current Terms of Service.
5. User Accounts
5.1. You must provide accurate, current, and complete information during the registration process and keep your account information up-to-date.
5.2. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
5.3. Sharing accounts is strictly prohibited. We monitor IP addresses and device usage patterns and reserve the right to terminate accounts that we reasonably believe are being shared.
6. Intellectual Property Rights
6.1. vDOC.AI retains all right, title, and interest in and to the Service, including all content, features, and functionality thereof. This includes, but is not limited to, all integrations, insights, interfaces, logos, code, network API calls, user-visible features, and our proprietary framework.
6.2. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for its intended purpose in accordance with these Terms.
6.3. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by us.
6.4. Any violation of our intellectual property rights may result in legal action. Damages from such violations will be paid for by the violating party, and any legal proceedings will take place in Idaho, USA.
7. User Conduct
7.1. You agree not to use the Service: a) In any way that violates any applicable federal, state, local, or international law or regulation. b) To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter,""spam," or any other similar solicitation. c) To impersonate or attempt to impersonate vDOC.AI, a vDOC.AI employee, another user, or any other person or entity. d) To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm vDOC.AI or users of the Service or expose them to liability.
7.2. We reserve the right to terminate your account if we find that you are abusing our platform in a perverted way, forcing errors, making false social media posts, or violating our Privacy Policy or these Terms of Service.
8. Disclaimer of Warranties
8.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
8.2. vDOC.AI EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS,IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
8.3. vDOC.AI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.
9. Limitation of Liability
9.1. vDOC.AI IS A MEDICAL TRAINING SIMULATION PLATFORM INTENDED SOLELY FOR EDUCATIONAL PURPOSES. IT IS NOT INTENDED FOR USE IN ACTUAL MEDICAL DIAGNOSIS, TREATMENT, OR PATIENT CARE DECISIONS.
9.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL vDOC.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; c) ANY CONTENT OBTAINED FROM THE SERVICE; AND d)UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
9.3. IN NO EVENT SHALL vDOC.AI'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID vDOC.AI IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).
9.4. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN vDOC.AI AND YOU.
9.5. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
9.6. YOU EXPRESSLY UNDERSTAND AND AGREE THAT vDOC.AI SHALL NOT BE LIABLE FOR ANY MEDICAL OR HEALTHCARE DECISIONS MADE BASED ON THE CONTENT PROVIDED THROUGH THE SERVICE. THE SERVICE IS AN EDUCATIONAL TOOL AND SHOULD NOT BE RELIED UPON AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
10. Indemnification
You agree to defend, indemnify, and hold harmless vDOC.AI, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service caused damage to a third party.
11. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the Laws of Idaho, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page and sending an email to the address associated with your account. Changes will be effective immediately upon posting.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
